Terms & Conditions
- By applying for the Anaconda Adventure Club® card (Card) the applicant agrees to be bound by the Anaconda Adventure Club® terms and conditions. These terms and conditions are binding on an applicant upon the issue of a Card to the applicant.
- Only individuals can apply for a Card. Trusts, partnerships, joint ventures, associations, corporations or any other body corporate cannot apply.
- Anaconda® may, in its absolute discretion and without giving reasons for its decision, accept or refuse an application for a Card.
- To apply for a Card and become a Cardholder, the person must either
- complete an Anaconda Adventure Club® application form (Application Form) and hand it in at any Anaconda® store;
- complete an Application Form on line at www.anaconda.com.au; or
- contact Anaconda® customer service on 1300 669 137 and complete an Application Form with the customer service consultant.
- A Cardholder may hold one (1) Card only.
- Cardholder rights are determined by Anaconda® from time to time and may include discounts for products purchased at Anaconda® stores.
- Discounts only apply to the Cardholder noted on the Card and may not be used in conjunction or combination with any other offer or promotion. Cardholder discounts are not available on goods at “sale” or “special” prices.
- The rights of a Cardholder are non-transferable and not redeemable for cash.
- Cardholder rights are valid until terminated or cancelled by Anaconda® (in its absolute discretion) or until the Cardholder notifies Anaconda® customer service on 1300 669 137 that he or she wishes to terminate their Card. If a Card is terminated the Cardholder must return the Card by hand to an Anaconda® store or by mail to Anaconda® Stores Pty Ltd, 100 Market Street, South Melbourne, Victoria 3205.
- Anaconda® may, in its absolute discretion and without giving reasons for its decision, at any time and without notice cancel any Card or substitute advertised discounts for any other item of a comparable value.
- Anaconda® is not responsible for stolen or lost Cards or Cards that are used fraudulently. The Cardholder must report a stolen or lost Card to Anaconda® immediately. The Cardholder’s existing Card will be cancelled and a new Card issued.
- All Cards remain the property of Anaconda®. Cards must be returned to Anaconda® immediately on demand by Anaconda®.
- Any questions regarding the Anaconda Adventure Club® should be referred to a local Anaconda® store or the Anaconda® customer service on 1300 669 137 or www.anaconda.com.au.
- Anaconda® reserves the right to suspend or terminate the Anaconda Adventure Club® at any time and without prior notice.
- Anaconda® shall not be liable in any way if benefits or promotions are unavailable as a result of a technical malfunction, operator fault, errors resulting from computer hardware or software errors or failure.
- The Anaconda Adventure Club®, components of the Anaconda Adventure Club® and its associated promotions may be amended or withdrawn by Anaconda® at any time without notice.
- Cardholders participating in Anaconda Adventure Club® and it’s associated promotions are bound by these terms and conditions and are subject to any other conditions imposed by Anaconda® from time to time.
- All discounts for Cardholders for purchases at Anaconda® stores including Shop at Home are subject to availability.
- Cardholder discounts are not negotiable, non transferable, or redeemable for cash.
- A Cardholder must produce their Card if seeking the benefit of any discount or other benefit offered to Cardholders, or upon request by Anaconda®.
- Anaconda® does not warrant in any way that the discounts or benefits for Cardholders will be available at any particular time or times or in any particular place.
- To the greatest extent permitted by law, Anaconda® gives no warranty and shall have no liability in respect of goods or services provided to Cardholders or as to the accuracy of any description or information about such goods or services, even though Anaconda® may have notified the Cardholder of those goods or services.
- Anaconda® is not liable in any way whatsoever for any injury or loss (including any indirect or consequential loss) of any kind to person or property suffered by any Cardholder whether by reason of any act or omission, deliberate or negligent, of Anaconda® in connection with the Anaconda Adventure Club®, including injury or loss incurred whilst participating in any activity of the Anaconda Adventure Club® or Anaconda® or in any activity in which Cardholders are invited to participate. This condition is subject to any liability with may not be lawfully excluded, in which case such liability will be limited to the greatest extent permitted by law.
- Anaconda® makes no warranty or representation as to the quality, suitability or merchantability of any goods or services offered as prizes.
- Cardholders indemnify Anaconda® for and against any loss or claim suffered or incurred by Anaconda® arising from or in connection with a breach of these terms and conditions by a Cardholder.
- Anaconda® reserves the right to vary these terms and conditions at any time for any reason and without notice to Cardholders. A copy of the current Anaconda Adventure Club® terms and conditions can be obtained from www.anaconda.com.au.
- Anaconda® holds and uses a Cardholder’s personal information in accordance with Anaconda’s® privacy policy (a copy of which can be obtained at www.anaconda.com.au).
- Anaconda’s® decision in connection with any aspect of the Anaconda Adventure Club® will be binding and final on each Cardholder.
- "Anaconda" means Anaconda® Stores Pty Ltd ABN 107 364 563 and includes where appropriate Anaconda’s® employees, agents, and contractors, officers and related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)). "Cardholder" means a person who has applied for a Card and whose application has been accepted by Anaconda®.
- For the avoidance of doubt, these terms and conditions supersede and replace any and all previous terms and conditions specifically governing the Anaconda Adventure Club®.
